MREC NOTICE: Updates To Disclosure/Disclaimer Form

ANNAPOLIS, Md. -- The Maryland Real Estate Commission has recently updated and revised the Maryland Residential Property Disclosure and Disclaimer Statement form.
 

The revised version is attached for your reference and is available on the Commission's website.

The Revisions approved by the Commission and published in COMAR (09.11.07.01) include the following:

  • The Disclosure questions were reformatted to allow for the numbered questions to begin on Page 1 of 4.
  • Disclosure Question #2: Sewage Disposal - Type of System Options added
  • Disclosure Question #2: Air Conditioning - Type of Cooling Options added
  • Disclosure Question #4: Basement - Type of Basement Options added
  • Disclosure Question #9: Air Conditioning - Type of Cooling Options added
  • Disclosure Question #12 A, B & C: Smoke Alarms - Feature Options added
  • Disclosure Question #13 A & B: Septic Systems - Type of System Options and Function Options added
  • Disclosure Question #18: Hazardous Materials - Type of Materials Options added
  • Disclosure Question #21 A: Open Violations Options added
  • Disclosure Question #24: Property Flooding or Fire question added
  • Notice to Purchaser regarding a Home Inspection: Language added above the Purchaser signature lines in both the Disclosure and Disclaimer sections

Please NOTE:

  • All Brokerages should now utilize the Revised Form
  • Any current non-exempt Residential Property listing agreements should be updated with the Revised form.
  • Any currently executed Residential Property Sales Agreements pending closing DO NOT need to be updated with the Revised form.
